By signing a working agreement with The 95 Agency, you agree to the following terms and conditions:

Currency

All prices listed on our website and provided during project discussions are in US dollars (USD).

Deposits and Payment

1. A 50% non-refundable deposit is required before work begins. This deposit secures your project in our schedule and allocates necessary resources.
2. The remaining 50% balance is due upon project completion, after your approval, and before the final deliverables are handed over.
3. A deposit invoice will be emailed to you at the project’s initiation.
4. The 95 Agency reserves the right to request full payment upfront if deemed necessary.

Payment Methods Accepted

1. All payments must be processed through our CRM portal.
2. We accept all major credit cards for secure and efficient transactions.
3. Payment schedules and invoices are available for review in the portal.

Cancellations and Refunds

1. You may cancel your project at any time; however, the deposit is non-refundable as it covers the initial work and resource allocation.
2. Refunds for payments beyond the deposit will be considered only if no additional work has been completed.

Communication

1. All project-related communication will be conducted through the Honeybook CRM portal to ensure clear and organized correspondence.
2. The 95 Agency staff monitors the platform daily for timely responses and updates.
3. Follow-up calls can be scheduled through the portal by either you or The 95 Agency.
4. Phone consultations and follow-ups may be recorded for record-keeping and quality assurance purposes.
5. Additional communication channels, such as email or instant messaging, may be utilized only if explicitly agreed upon.

Revisions

1. Each project includes a specified number of revisions, outlined in the initial agreement.
2. Additional revisions are available at an hourly rate, which will be quoted based on the project’s scope and complexity.
3. Revisions must be requested within the project’s active timeline. Delayed requests may result in additional charges or project rescheduling.

Abandoned Projects

1. Projects are considered abandoned if we do not receive a response from you within 30 days of the last communication.
   • In such cases, all rights to the presented work are forfeited unless the project is paid in full.
   • Restarting an abandoned project will incur a reactivation fee.
2. Product development projects will be deemed abandoned after 90 days of inactivity due to their extended nature.
   • Reactivating a product development project after abandonment will require a new timeline and potential additional fees.

Portfolio and Website Credit

1. The 95 Agency reserves the right to feature completed projects in its portfolio, marketing materials, and website.
2. If you prefer your project to remain private, you must inform us in writing before project completion.

Copyright and Usage Rights

1. All graphic designs and creative assets are custom-created and exclusive to your business.
2. Concepts and designs not selected or paid for remain the intellectual property of The 95 Agency and cannot be used without our written permission.
3. Once the project is paid in full, you obtain the rights to use the final deliverables as agreed upon. However, The 95 Agency retains the right to showcase the work in its portfolio unless otherwise stated.

Timelines and Deadlines

1. The 95 Agency will provide an estimated timeline for each project. Meeting this timeline requires prompt responses and approvals from you.
2. Delays in feedback or approvals may result in adjustments to the project schedule.
3. Rush services may be available for an additional fee and must be agreed upon in writing.

Confidentiality

1. The 95 Agency respects your privacy and ensures that any confidential information shared during the project remains protected.
2. Both parties agree not to disclose sensitive information without prior written consent.

Liability

1. The 95 Agency is not liable for any damages or losses resulting from the use of our services, including but not limited to missed deadlines caused by client delays.
2. While we strive for perfection, the final responsibility for proofing and approving deliverables lies with you.

Contract with The 95 Agency

1. By entering into a working agreement with The 95 Agency, you consent to adhere to these policies and procedures.
2. These policies and procedures are subject to change or updates at any time without prior notice. We recommend reviewing them periodically.
3. Any disputes arising from this agreement will be resolved in accordance with the laws of the state in which The 95 Agency operates.
